The Solicitor Instruction Letter: Your Faraid Calculation, in a Form a UK Solicitor Can Draft From

You have worked out how your estate should be divided under Islamic law. The next step is a will that actually does it — and that means a solicitor. The Solicitor Instruction Letter is a £29 document that carries your Faraid distribution across that gap. It sets out who inherits what, in the wording and format a UK private client solicitor works from.

In short

The Faraid calculation is free. The report is £29, charged once per case, and is optional.

It contains an estate summary, suggested Gift of Residue clause wording with every heir’s fraction, the priority of distribution, and drafting notes for the solicitor.

It is not a will and never becomes one. Your solicitor drafts and executes the will; this tells them what it should say.

The problem this solves

Most UK solicitors are competent at wills and unfamiliar with Faraid. That is not a criticism — it is a specialist area of religious law with its own vocabulary, and there is no reason a general private client practitioner would know it.

The practical consequence is a gap. A family arrives knowing the estate should follow Islamic shares, and the solicitor is asked to draft something they cannot independently derive. What tends to follow is either a long billed conversation working it out together, or a will that expresses the intention loosely enough to cause problems later.

The report closes that gap by arriving with the distribution already worked out, already expressed in fractions and amounts, and already drafted into clause wording the solicitor can adapt. Their job becomes reviewing and drafting rather than deriving.

Inside the report

A cover page identifying the case, then four lettered sections.

Section What it contains
A — Estate Summary Gross estate, funeral costs, debts and any wasiyyah, with the net figure the distribution is calculated on.
B — Suggested Gift of Residue Clause Draft clause wording naming each heir with their fraction in words, as a percentage and as a monetary amount. This is the section the solicitor adapts directly into the will.
C — Priority of Distribution The order in which claims come out of the estate — funeral costs, debts, wasiyyah, then Faraid — so the sequencing is explicit rather than assumed.
D — Notes for Drafting Executor appointment, STEP provisions, a flag where any heir is a minor, and Wills Act 1837 execution requirements.

Alongside those sections the report carries the distribution table, the Quranic basis for every share, the madhab the calculation was produced under, and a legal notice stating plainly what the document is and is not.

What it is not

Being precise here matters more than selling.

  • It is not a will. It has no legal effect on its own, and it does not become a will by being signed or witnessed. A will takes effect in England and Wales when executed to the standard of the Wills Act 1837.
  • It is not legal advice. It states a calculation and suggests wording. It does not advise you on your circumstances.
  • It is not a fatwa. It applies the rules of the madhab you selected. It does not rule on a contested religious question, and unusual family situations still warrant a scholar.
  • It is not a valuation. The figures are the ones you entered. Property, pensions and jointly held assets need checking before those figures are right.
  • It does not bind your solicitor. They are entitled to verify the distribution independently, and a careful one will.

What your solicitor still does

The report covers the distribution. Everything below remains professional legal work, and the £29 does not touch it:

  • Verifying the heirs and your family circumstances
  • Valuing the estate properly, including property and business interests
  • Advising on Inheritance Tax
  • Advising on possible claims under the Inheritance (Provision for Family and Dependants) Act 1975
  • Dealing with jointly held property, which can bypass the estate entirely, and with pension and life policy nominations
  • Appointing executors and, where heirs are minors, trustees
  • Drafting the will and executing it correctly

If you do not yet have a solicitor, the SRA’s register lists regulated firms. Solicitors who want to understand the document before a client arrives with one can read Mizaanly for solicitors.

How to get one

  1. Run the calculation. Enter the estate, the surviving family and your madhab. Free, and no account needed to see that it works.
  2. Review the distribution. Every share, its Quranic basis, and any heir excluded by hajb, with the relative who excluded them named. Still free.
  3. Create a free account to save the case.
  4. Buy the report if you want it — £29, once for that case. Payment is handled by Stripe; Mizaanly does not store card details.
  5. Take it to your solicitor and have the will drafted and executed.

The order matters: you see the complete distribution before you are asked to pay anything.

Price

£29, once per case. Not a subscription, not per heir, not per download.

Free, and staying free: the calculation itself, every heir’s share, the Quranic basis for each one, awl and radd adjustments, hajb exclusions, and all four madhabs. The report is the only paid item on the site.

A separate case — a different person’s estate — is a separate £29. Refund terms are in the refund policy.

Who needs one, and who does not

Worth it if

  • You are instructing a solicitor to draft a Sharia-compliant will and want the distribution settled before you walk in.
  • Your solicitor is unfamiliar with Faraid and you would rather not pay them to work it out.
  • Your family situation involves siblings, grandparents, or an exclusion, where the arithmetic is not obvious.
  • You want the Quranic basis for each share recorded in writing alongside the figures.

Probably not needed if

  • You only wanted to understand the shares — the free calculation already gives you that.
  • Your solicitor already specialises in Islamic estate planning and derives the distribution themselves.
  • You are not yet ready to make a will. The calculation keeps; buy the report when you instruct someone.

See your distribution first. Decide about the report afterwards.

Common questions

What is a Solicitor Instruction Letter?

A document setting out your Faraid distribution in the form a UK solicitor needs to draft a will: estate summary, suggested Gift of Residue clause wording with each heir’s fraction, priority of distribution, and drafting notes. You hand it over; they draft and execute.

How much does the Islamic inheritance report cost?

£29, once per case. The calculation is free and stays free. No subscription.

Is it a will?

No, and it does not become one. It is an instruction document. A will takes legal effect in England and Wales only when executed under the Wills Act 1837, which requires a solicitor.

Will a UK solicitor accept it?

It is written in the register a private client solicitor expects, with fractions in words, percentages and amounts, and suggested clause wording they can adapt rather than draft from scratch. Solicitors remain free to verify the distribution independently and are expected to. No solicitor is obliged to accept any third-party document.

What does my solicitor still have to do?

Verify heirs, value the estate, advise on IHT and the 1975 Act, handle joint property and pension nominations, appoint executors and trustees, and draft and execute the will. The report gives them the distribution; the legal work stays theirs.

Which madhab does it use?

The one you selected before calculating — Hanafi, Shafi‘i, Maliki or Hanbali. The report names it explicitly so your solicitor and any scholar reviewing it can see the basis. See how the four madhabs differ.

Can I get a refund?

Refund terms are set out in the refund policy. Payment is processed by Stripe; Mizaanly does not store or access card details.
